Introduction

We know your privacy is very important and we want to keep you informed of how it is honored here at HomployeeHub. Accordingly, Z-Suite LLC dba HomployeeHub (“HomployeeHub,” “we,” or “us”) prepared this Privacy Policy (“Policy”) to openly share how we handle information you provide to us online and preemptively address any privacy concerns you may have. This Policy describes how we collect, maintain and process personally identifiable information including non-public personal information we obtain regarding individuals (“personal information”) in connection with your access or use of any website or consumer application (“Sites” or “Site”) and services, products, subscriptions, applications, memberships, or other offerings (“Services”). All collection, use disclosure and processing of personal information by HomployeeHub about individuals will vary depending upon the varied use of our Sites and Services. This Policy is intended to provide our general practices and processes, but different or additional notices may be provided and apply to certain personal information. 

 

You may elect not to visit our Sites or use our Services if you disagree with this Policy. By accessing our Sites and using our Services or providing us with information in connection with our Services, you agree to our Privacy Policy and you expressly consent to the processing of your personal information according to our Privacy Policy and the terms contained herein. 

Changes to HomployeeHub Privacy Policy 

We reserve the right to modify this Privacy Policy at any time without notice, so please review it frequently. Changes and clarifications will take effect immediately upon their posing on the Sites. We will make reasonable efforts to notify you of changes by sending a notice to the latest email address you provided to us; however, if a change is made to your email address that we are unaware of, a communication sent to the last email you provided operates as effective notice. 

What Types of Information Does HomployeeHub Collect

We receive, collect and store any information you enter on our website or provide to us in any other way. In addition, we collect the Internet Protocol (IP) address used to connect your computer to the Internet; login; email address; password; computer and connection information and purchase history. We may use software tools to collect session information, including but not limited to page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, survey information you provide, feedback, product reviews, recommendations and personal profile information. 

 

The information we collect is generally provided directly from you, the Site visitor (e.g. forms you complete, Services you use, or products you purchase); however, it may also come indirectly from you (e.g. observing your interaction with our Site or other Sites which employ our cookies or other internet tracking mechanisms) or from other sources like third party marketing companies that we use to provide you with our Services, product offerings and other information. Data we receive from other sources may be combined with the information you provide us, and may be used, shared or sold for purposes as outlined in this Policy. By continuing to use our Sites, you are agreeing to use our cookies. Most web browsers automatically accept cookies, but will also provide controls that allow you to block or delete them. Information can also be obtained from social networking sites. In some cases, you can sign-in to the services using your social networking sites information. By sharing your social networking site profile, you allow us to access some of your profile data that may be imported to the Services. Our Services also allow us to share information via such social networking sites. You acknowledge and agree that you are solely responsible for your use of social networking sites and that it is your responsibility to review the terms of use and privacy policy of the third party provider of such social networking sites. You can remove your social networking site profile information via your Account Settings, as applicable, which will delete the related information from our database. 

Why HomployeeHub Collects Non-Personal and Personal Information

We collect personal and non-personal information for the following purposes: 

  • To perform our contract with you and as necessary to provide and operate our Services

  • To provide our customers with ongoing customer assistance and technical support

  • To be able to contact our Site visitors and users with general or personalized service-related or administrative notices and promotional messages

  • To create aggregated statistical data and other aggregated and/or inferred non-personal information which we or our business partners may use to provide and improve our respective services

  • To provide you with information on updates pertaining to your prior or current orders, or company news, promotions, surveys, related product or service information, etc. (Note, we include unsubscribe instructions at the bottom of each email that you may use anytime or you can opt-out by contacting us at info@homployeehub.com)

  • To send you administrative notifications, such as security, IT or support and maintenance advisories

  • To comply with applicable laws and regulations, including any audits or investigations 

  • To effectuate any mergers, acquisitions, integrations and other business transfers

  • To prevent fraud or for physical, IT and network perimeter security measures for our users’ safety

  • To carry out targeted promotional activities and analyze site traffic to understand our consumer needs and trends

How  Does HomployeeHub Share My Information

We may share your personal information with any HomployeeHub affiliates, contractors, service providers or other third parties that support our business including those who assist us with fulfilling orders, marketing, advertising or other market research. We may also share with (a) Software/IT service providers we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them, (b) banks and credit card processors to the extent necessary to deliver the Services. HomployeeHub reserves the right to share, sell or trade data collected to any third party.

 

We may use your non-personal information by itself or aggregate it with information we obtain from others. Such aggregated data is generally anonymized such that it does not personally identify any individual, device or household. When you visit our Sites, you assume the risk that the information you provide will fall into the wrong hands. You hereby acknowledge that we cannot guarantee the security of the information you provide to us and you accept that HomployeeHub is not responsible or liable for the activities of third parties. 

Where is HomployeeHub’s Site Hosted

Our Sites are hosted on the wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases, and the general Wix.com applications. They store your data on secure servers behind a firewall. 

 

All direct payment gateways offered by Wix.com and used by HomployeeHub adhere to the standards set by PCI-DSS as managed by the PCI SEcurity Standards Council, which is a joint effort among credit card issuers. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. 

How HomployeeHub May Contact You

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about HomployeeHub's operations or offerings, or as otherwise necessary under applicable law. For these purposes, we may contact you via email, telephone, text message and postal mail.

Promotional Communications

By creating an account at the site, purchasing a product, signing up for a giveaway, or logging into the site using a social network site, you agree to receive free content and promotional offers from HomployeeHub, or its affiliates or third parties. 

 

Linked Sites

When visiting our Sites, you may be directed to other consumer applications or websites that are outside of HomployeeHub’s control. This Privacy Policy does not cover and we are not responsible for the collection of information by those other companies as their activities are outside our control. We encourage you to review the privacy policies of those individual websites you elect to visit. 

 

Children’s Privacy

Our Sites and Services do not target or knowingly collect or use any information from individuals under the age of legal majority in the jurisdiction where the Site is accessed. If you have actual knowledge that personal information about a child under the legal age of majority has been collected or shared with us, please notify us at info@homployeehub.com, and we will take reasonable and appropriate steps to try and delete such information. 

 

Effective Date of this Policy

This Policy is effective as of the date of its posting on the Site, and as amended from time-to-time at HomployeeHub’s sole election, including the most recent version dated August 28, 2020. 

Site Tracking Technology

Our Sites may use "cookies" and other tracking technologies to understand information about how you interact with our Sites, which may include information such as demographic data, browser type, IP address, pages visited, activities conducted on the page, and the day and time of your visit. We do not currently honor "do not track" signals from a web site browser.

By using HomployeeHub's Sites and Services and/or providing us with your information, you hereby accept, acknowledge and agree to be bound by this Policy. Your information may be processed in the country in which it was collected and in other countries, including the United States. By providing your information, you consent to such transfer. 

 

General Data Protection Regulation (GDPR)

Due to the nature of its business and associated shipping restrictions in place, HomployeeHub does not knowingly conduct any transactions with any residents of the European Union or knowingly collect any information from residents of the European Union. However, should any GDPR data requests be necessary, please direct them to info@homployeehub.com

 

California Residents (California Consumer Privacy Act Policy Statement)

This section addresses the requirements applicable to California residents under the California Consumer Privacy Act (“CCPA”), regarding the handling of their personal information. This section does not address or apply to our handling of publicly available information made lawfully available by state or federal governments or other personal information that is subject to an exemption under the CCPA.

 

HomployeeHub’s collection, use and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such resident. The table below sets out generally the categories of personal information (as defined by the CCPA) about California residents that we may collect, sell, and disclose to others for a business purpose. We collect these categories of personal information from the sources described and for the purposes also detailed below.

A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, passport number, or other similar identifiers.

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code 1798.80(e)) -  YES

A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some personal information included in this category may overlap with other categories.

C. Protected classification characteristics under California or federal law - YES

Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).

D. Commercial information - YES

Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

E. Biometric information - YES

Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

F. Internet or other similar network activity - YES

Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.

G. Geolocation data - YES

Physical location or movements.

H. Sensory data - NO

Audio, electronic, visual, thermal, olfactory, or similar information.

I. Professional or employment-related information - YES

Current or past job history or performance evaluations.

J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. 1232g, 34 CFR Part 99)) - NO

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

K. Inferences drawn from other personal information - YES

Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Personal information does not include:

  • Publicly available information from government records.

  • De-identified or aggregated consumer information.

  • Information excluded from the CCPA's scope, like:

    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

    • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

 

In the event that you are a “consumer” of HomployeeHub and HomployeeHub is a “business” as defined under the California Consumer Privacy Act (which HomployeeHub denies at the current time), you have a right to request (1) a list of categories of personal data HomployeeHub has collected about you, (2) specific data HomployeeHub has collected about you, (3) categories of sources from which the personal data is collected (which can be found above in this Policy), (4) business or commercial purpose for collecting personal data, (5) categories of third parties with whom HomployeeHub shares personal data (which can be found above in this Policy). 

 

California consumers also have a right to request deletion of any personal data HomployeeHub collected about you. If you seek to exercise the foregoing rights to access or delete personal data which constitutes “personal information” under CCPA, please contact us at info@homployeehub.com or 5010 Harbor Ln. North, Plymouth, MN 55446. We respond to all requests we receive under CCPA within the time parameters set forth under applicable law. By submitting such a request, you agree to receive follow-up communications from HomployeeHub to verify your identity and any other information necessary to complete your request. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

 

We may disclose your personal information to a third party for a business purpose.  When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

 

In the preceding twelve (12) months, we have not disclosed any information for any of the categories of personal information for a business purpose identified in the chart immediately above for categories A-K. We anticipate conducting such disclosures for business purposes for categories A-K and will continue to update this section as appropriate. 

 

The CCPA defines a “sale” as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration. While we do not disclose personal information to third parties in exchange for monetary compensation from such third parties currently, we do disclose or make available the categories of personal information that we collect to our affiliates. We may make certain categories of personal information available to third parties, in order to receive certain services or benefits from them (such as when we allow third party tags to collect browsing history and other information on our Services to improve and measure our ad campaigns), including:

  • Category A. Identifiers. Name, contact information and other identifiers

  • Category B. Personal information categories listed in the California Customer Records statute. Customer Records, Profiles and inferences

  • Category C. Protected classification characteristics under California or federal law. Customer Records, Profiles and inferences.

  • Category D. Commercial Information. Usage data, records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

 

California law grants California residents certain rights and imposes restrictions on particular business practices as set forth below.

  • Do-Not-Sell: California residents have the right to opt-out of our sale of their personal information. Opt-out rights can be exercised by sending an email to info@homployeehub.com or clicking the link “Do Not Sell My Personal Information”. We do not sell personal information about residents who we know are younger than 16 years old without opt-in consent.

  • Initial Notice: We are required to notify California residents, at or before the point of collection of their personal information, the categories of personal information collected and the purposes for which such information is used.

  • Request to Delete: California residents have the right to request deletion of their personal information that we have collected about them and to have such personal information deleted, except where an exemption applies. We will respond to verifiable requests received from California residents as required by law.

  • Request to Know: California residents have the right to request and, subject to certain exemptions, receive a copy of the specific pieces of personal information that we have collected about them in the prior 12 months and to have this delivered, free of charge, either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, readily useable format that allows the individual to transmit this information to another entity without hindrance. California residents also have the right to request that we provide them certain information about how we have handled their personal information in the prior 12 months, including:

    • categories of personal information collected;

    • categories of sources of personal information;

    • business and/or commercial purposes for collecting and selling their personal information;

    • categories of third parties/with whom we have disclosed or shared their personal information;

    • categories of personal information that we have disclosed or shared with a third party for a business purpose;

    • categories of personal information collected; and

    • categories of third parties to whom the residents’ personal information has been sold and the specific categories of personal information sold to each category of third party.

 

California residents may make a Request to Know up to twice every 12 months. We will respond to verifiable requests received from California residents as required by law.

  • Right to non-discrimination: The CCPA prohibits discrimination against California residents for exercising their rights under the CCPA. Discrimination may exist where a business denies or provides a different level or quality of goods or services, or charges (or suggests that it will charge) different prices, rates, or penalties on residents who exercise their CCPA rights, unless doing so is reasonably related to the value provided to the business by the residents’ data.

  • Financial incentives: A business may offer financial incentives for the collection, sale or deletion of California residents’ personal information, where the incentive is not unjust, unreasonable, coercive or usurious, and is made available in compliance with applicable transparency, informed consent, and opt-out requirements. California residents have the right to be notified of any financial incentives offers and their material terms, the right to opt-out of such incentives at any time, and may not be included in such incentives without their prior informed opt-in consent. We do not offer any such incentives at this time.

You may only make a verifiable consumer request to know information twice within a 12-month period.  We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

 

Once we receive your verifiable consumer request, we will send you an acknowledgement letter within 10 days which will describe our verification process. We will respond to your request within 45 days, if we are able to verify your identity. Requests for deletion will require a separate confirmation that you want your information deleted.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Please note we are unable to disclose or provide you with your Social Security Number, Driver’s License Number, or other government issued identification number, financial account number, any health insurance or medical identification number, an account password, or security questions and answers.
